Acceptable Use Policy

This Acceptable Use Policy ("AUP") defines prohibited uses of PostMTA Hosted's email delivery services. Violations may result in immediate suspension or permanent termination without refund.

1. Prohibited Content

You may NOT use PostMTA Hosted to send, facilitate, or promote content that:

  • Is unlawful, harmful, threatening, defamatory, or invasive of another person's privacy
  • Constitutes unsolicited bulk email ("spam"), unsolicited commercial email (UCE), or any bulk message sent without documented recipient consent
  • Contains malware, viruses, ransomware, trojans, worms, or any malicious code or software
  • Impersonates any person or entity, or misrepresents your affiliation with any person or entity
  • Contains phishing, fraudulent offers, deceptive marketing, or "get rich quick" schemes
  • Violates the CAN-SPAM Act, CASL, GDPR, UK GDPR, or any other applicable anti-spam or data protection law
  • Infringes on any third-party intellectual property, trademark, copyright, or right of publicity
  • Contains obscene, pornographic, or explicit material — except for legally age-verified adult-content sites with documented sender compliance practices pre-approved by PostMTA
  • Relates to illegal gambling, lottery, or sweepstakes schemes not properly licensed in all recipient jurisdictions
  • Relates to the sale of regulated substances, weapons, explosives, or controlled substances
  • Contains hate speech, harassment, violence, or content that incites discrimination

2. Prohibited Sending Practices

The following sending practices are strictly prohibited:

  • Sending to purchased, rented, scraped, or third-party email lists without documented, verifiable consent from each recipient
  • Failing to honour unsubscribe requests within 10 business days
  • Using misleading, false, or deceptive subject lines, sender names, or from addresses
  • Hiding or falsifying the sender's physical mailing address (required by CAN-SPAM)
  • Attempting to circumvent spam filters, reputation systems, rate limits, or sending controls
  • Using PostMTA infrastructure to relay email for unauthorised third parties
  • Attempting to probe, scan, test, or exploit vulnerabilities in PostMTA systems
  • Accessing PostMTA systems for any purpose not explicitly authorised under your plan
  • Sending email where the primary purpose is to drive traffic to a landing page that itself violates this AUP

3. List Quality Requirements

To maintain deliverability and protect our shared IP reputation, all senders must comply with these thresholds:

All recipient addresses must have been collected via documented, affirmative opt-in. Addresses must be verifiable (no role accounts such as postmaster@, abuse@, etc.).

4. Enforcement Actions

PostMTA continuously monitors the platform for AUP violations using:

  • Spam trap detection and honeypot monitoring across all sending IPs
  • Complaint Feedback Loops (FBL) with Gmail, Microsoft (Outlook/Hotmail), Yahoo, and Comcast
  • Third-party blocklist monitoring (Spamhaus, SORBS, UCEPROTECT, Barracuda)
  • Content scanning for malware signatures and phishing patterns (applied at time of send)
  • Anomalous sending velocity detection

Violations result in escalating enforcement actions:

  1. Warning: Written notice to the registered account email, with a remediation deadline (typically 48 hours for serious violations)
  2. Mandatory unsubscription cleanup: All current suppression lists must be reconciled; no new sending until verified
  3. Sending suspension: Temporary halt to all outbound email from the account; access to the dashboard remains
  4. Account termination: Permanent removal from the platform, no refund of unused credits; data retained per our Privacy Policy then deleted
  5. Referral to authorities: Cases involving illegal content, fraud, or child exploitation are reported to law enforcement without notice
Zero tolerance: Any single spam trap hit, credible phishing report from an ISP, or evidence of purchased-list sending may result in immediate permanent termination without prior warning.

5. Complaint Handling Procedure

When a recipient marks your email as spam (a "complaint"), the following process applies:

  1. The ISP forwards the complaint to PostMTA via our FBL integration
  2. The sending address is immediately added to your suppression list — you cannot re-send to that address
  3. Complaint rate is recalculated across your account
  4. If your complaint rate exceeds 0.1%, your account is flagged for review
  5. PostMTA may require you to submit a remediation plan before sending can resume

You may not discourage recipients from filing complaints (e.g., pre-checked opt-out boxes, confusing unsubscribe flows).

6. Reporting Abuse

To report a PostMTA customer sending abuse, phishing, or spam:

  • Full email headers of the offending message
  • The sender's domain and sending IP (visible in headers)
  • Your relationship to the sender (recipient, third party, etc.)

We aim to acknowledge abuse reports within 4 business hours and take action within 24 hours for credible reports.
